Motorcycle riding is fun but hazardous. Motorcycle racing is very dangerous because of its high speed and unexpected movements of other racers. Motorace assumes no responsibility or liability for your decision to participate in this dangerous motorsport. Failures of equipment, new and old, can occur suddenly, without warning, and with grave

consequences. The longer you ride, the greater the probability you will eventually crash. No amount of protective equipment can prevent you from being injured or killed. Motorace assumes no liability or responsibility for this and gives no warranty or guarantee as to safety or suitability for use of any product. Remember... ride safely, always check your tire pressure before you start and wear an approved helmet. WARRANTIES:

Motorace makes no warranty to products it distributes, express or implied, including without limitation any warranties of merchantability and/or ftness for a specifc purpose. All warranties made by the product manufacturer will be that company’s responsibility to fulfll. TERMS:

All orders will be shipped prepaid by check or credit card. Trade customers can make arrangements for open account. Interest will be charged on any past due balances at a rate of 1.5% per month, or maximum allowed by State Law. SHIPPING / DAMAGES:

Daily shipments are made FOB Motorace warehouse. We will ship by the most appropriate carrier according to the size and weight of your order. Ownership of product

transfers to you at the moment the carrier picks up the freight. The Common Carrier assumes liability for your merchandise at our shipping dock. Claims for loss or damage must be made directly with the delivering carrier. Loss or damage to merchandise does not alleviate your responsibility for payment of our invoice in accordance with the

stated terms. Alert your receiving clerks to count the number of parcels in each shipment carefully and compare the total with that stated on the delivering carrier’s Bill of Lading. If parcels arrive in a damaged condition or there is a shortage, note these discrepancies on the Bill of Lading at the time you sign for the shipment. Immediately request a claim form and inspection from the delivering carrier. If you unpack the shipment and discover concealed damage or pilferage, do not destroy any of the containers or proceed further until you fle a claim form and receive an inspection from the delivering carrier. You still are responsible for paying the Motorace invoice. RETURNS:

All sales are fnal except for defects in manufacturing. Do not return merchandise without prior approval. Returned merchandise must be accompanied by a copy of the

original Motorace sales invoice. Returns must be sent prepaid. Shortages and discrepancies must be reported within 6 days of invoice date. Authorized returns are subject to a 20% restocking charge. Unauthorized returns are subject to a 25% restocking charge. PRICES:

We reserve the right to change prices without notice and to bill at the prevailing price at the time of shipment. Always check your latest invoice for cost. SERVICE:

Prompt service is our primary consideration. Motorace will make every effort to ship your order the same day it is received if you call before 3 PM Eastern time. PROVISIONS:

(a) These terms apply to all our sales and may not be changed. Failure to return goods within 10 days of invoice date shall constitute your acceptance of products and payment terms.

(b) We make no warranty as to products distributed by us, express or implied, including without limitation any warranties of merchantability and ftness for a particular purpose. The manufacturer shall be solely responsible for any damage to person or property arising from the design, manufacture and use of its products. Motorace accepts no liability for such damages.

(c) Motorace shall not be liable for indirect or consequential damages. (d) If legal action is necessary to collect a past due account, then Motorace shall be entitled to its attorney’s fees and costs in addition to any other relief it may receive. (e) Massachusetts law and jurisdiction shall apply in any dispute.

(f) Wholesale prices extended only to established businesses purchasing for resale. Possession of this Catalog or Price List does not constitute an offer to sell. We reserve the right to refuse or reject any order. Revised June 1, 2014
